About Employment Standards Laws
1. What is that?
Employment standards laws, a government program under Manitoba Finance, set a basic level of rights for employees, such as minimum wages, hours of work, holidays and other workplace entitlements and responsibilities, etc. The program enforces the Employment Standards Code, The Construction Industry Wages Act, The Remembrance Day Act, The Worker Recruitment and Protection Act and The Retail Businesses Holiday Closing Act. Some employers provide more benefits, but no one can agree to work for less than the minimum rules. It also investigates complaints about violations of these laws.
2. Who is covered by the Employment Standards laws in Manitoba?
Most employees in Manitoba fall under provincial jurisdiction. Some employees work in industries regulated by the federal government. These employees must contact the Canada Labour Program if they have concerns about how their wages have been paid. Independent contractors are not employees and are not covered by employment standards legislation.
Other employees, such as some agricultural workers, construction workers, professionals, part-time domestic workers, landscape workers and, election workers are entitled to some employment standards but not all.
3. Minimum Wage
The minimum wage is $11.65 per hour as of October 1, 2019.
Security Guard Minimum Wage is $12.50 per hour.

Manitoba Provincial Nominee Programs (MPNP) for immigrants
The central state of Manitoba is the fifth most populous state in Canada and one of the three prairie states. The Manitoba Provincial Nominee Program (MPNP) is one of the fastest ways of achieving a Canadian Permanent Resident (PR) status under the Canada Express Entry program. Manitoba has a high demand for skilled workers and therefore issues application letters more frequently than provincial nominee programs from other states of Canada.
If you meet all the requirements for this Manitoba immigration program, there are some following streams under the revamped Manitoba Provincial Nominee Program (MPNP) for you to select. They are:
- Skilled Worker Immigration Stream – including those in Manitoba and Overseas
- Manitoba Business Investor Stream
- Morden Community Driven Immigration Initiative – through the MPNP
- International Education Stream
1. Skilled Worker Immigration Stream
The Skilled Worker categories operate through an Expression of Interest(EOI) system which helps eligible candidates complete a series of questions online and do not need to upload supporting documentation before submitting their profile into the EOI pool. Based on your answers, the online system will give you score and then the MPNP will rank you using several factors. You may get an invitation to submit an application to the MPNP if you are among the top-scoring candidates. There are no limits on the number of candidates who can submit an Expression of Interest and no deadline.
There are currently two streams to Manitoba for the skilled worker under the MPNP Expression of Interest System. As part of the MPNP renewal, the Skilled Worker Immigration Streams will consist of four pathways below.
A. The Skilled Worker in Manitoba Stream
Temporary foreign workers and international student graduates who are currently working in Manitoba and have been offered permanent, full-time jobs in Manitoba are qualified to apply to this stream. Unlike the other connections to Manitoba in the MPNP, Skilled Workers in Manitoba are not subject to a points-based assessment. As part of the MPNP renewal, the Skilled Worker in Manitoba Stream will consist of two pathways: Manitoba Work Experience and Employer Direct Recruitment.
The Manitoba Work Experience Pathway of the Manitoba Provincial Nominee Program targets skilled temporary workers and graduates in Manitoba who wish to settle and have jobs in Manitoba as permanent residents.
The Employer Direct Recruitment Pathway targets skilled workers overseas whose expertise is required in Manitoba.
B. The Skilled Worker Overseas Stream
The Manitoba Skilled Worker Overseas Stream uses a points-based system to assess candidates, who may be outside of Canada. Applications are accepted from qualified skilled workers who can demonstrate a strong connection to the province through family or friends (Manitoba Support), past education or employment (Manitoba Experience), or by invitation of the MPNP (Manitoba Invitation), and who score a minimum of 60 points according to five eligibility factors: age, language proficiency, work experience, education, and adaptability.
This pathway is a way for Express Entry candidates who are also eligible under another MPNP stream and who meet Express Entry requirements and have an active Express Entry profile. Successful candidates are awarded 600 additional Comprehensive Ranking System (CRS) points, resulting in quick issuance of an invitation to apply for permanent residence and fast-track processing.
This pathway will be open to foreign skilled workers with experience in Manitoba’s In-demand Occupations, and who demonstrate the ability to potentially establish themselves by building strong labor market connections to those occupations.
Immigration to Manitoba through the Manitoba Human Capital Pathway (HCP) is one of the upcoming changes to the Manitoba Provincial Nominee Program, scheduled to come into effect in 2019.
2. Manitoba Business Investor Stream
Individuals who have the desire to do business in Manitoba can do so through this stream. This process operates on an ‘Expression of Interest’ system, whereby prospective applicants submit their intention to apply to the program, and the most qualified are invited to apply for immigration.
The Manitoba Farm Investor Pathway provides a route to Canadian permanent residence for investors and entrepreneurs who wish to purchase or start a farming business in Manitoba.
The Manitoba Business Investor stream is for investors and entrepreneurs who wish to purchase or start a business in Manitoba. Successful applicants to the Entrepreneur Pathway will receive a temporary work permit and sign a business performance agreement to purchase an existing business in the province or start a new business, which can help to have jobs in Manitoba.
3. Morden Community Driven Immigration Initiative
One particular initiative for immigration to Manitoba is the Morden Community Driven Immigration Initiative. This rural town, situated 112 km southwest of Winnipeg, is actively looking for new immigrants in certain occupations. Immigration to Morden is conducted through the MPNP.
4. International Education Stream

International graduates of universities and colleges in Manitoba can look to the Career Employment Pathway as their potential route to permanent residence.
The Manitoba Graduate Internship Pathway provides nomination pathways for international graduates of a Master’s or Doctoral (Ph.D.) study program who then complete an internship contributing to industry innovation in Manitoba.
The Manitoba International Student Entrepreneur Pilot provides international students who have graduated in Manitoba the opportunity to pursue entrepreneurship in order to have jobs in Manitoba.
